These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with https://zonepharma.com website (the “Service”) operated by Zonepharma SAS (“we”, “us” or “our”).

Please read these Terms and Conditions carefully before using the Service.

Access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of the terms, you cannot access the Service and must close the browser tab.

Political knowledge data processing and express authorization for the treatment, reporting and administration of data

In compliance with the Political Constitution of Colombia, Law 1266 of 2008, Law 1581 of 2012, Decree 1377 of 2013 and other laws that modify or complement data processing requirements, any data provided to Zonepharma in development and in exercise of the corporate purpose, will be administered, stored, and processed in accordance with the policies and procedures established by the Privacy Policy and the Terms & Conditions. Zonepharma S.A.S is responsible for the data obtained through different information channels to manage, store, consult, report, modify and update. In the same way, Zonepharma S.A.S guarantees the confidentiality, security, veracity, transparency, access, and restricted circulation of data. Zonepharma SAS reserves the right to modify its Policy of Processing of Personal Data at any time.

Upon acceptance of this document, I declare that:

1. A) I have been informed: 1) That Zonepharma S.A.S., acts and will act as Responsible for the Processing of my personal data or of the company I represent and that together or separately it may collect, use and process my personal data or those of the company I represent, in accordance with the Personal Data Processing Policy of Zonepharma S.A.S., 2) That it is optional to answer questions about Sensitive Data or minors, 3) That I know my rights as the owner of the data, provided for in the Constitution and the law, especially the right to know, update, rectify, cancel, to present opposition and delete information, as well as the right to revoke the consent granted for the Processing of Personal Data and that these can be exercises observing the Treatment Policy of Personal Data of Zonepharma S.A.S., through the free channels provided by Zonepharma S.A.S.
2. B) Acting in my own name and / or on behalf of the company I represent, I declare that the information provided is true and I give my express consent freely and irrevocably to Zonepharma S.A.S., to: 1) Consult and transfer at any time, in the databases managed by a financial operator or risk center, all the information to know my behavior as a debtor, ability to pay, the viability to enter into or maintain a contractual relationship, or for any other purpose, 2) Report in risk centers or any other database, data processed or untreated, on the fulfillment or breach of my credit obligations, legal duties of patrimonial content, location and contact data, credit applications, as well as others related to your commercial, financial and generally socio-economic relations that you have delivered or that appear in public records, public databases or public documents or in this format, 3) Exercise the right at any time to corroborate in the risk information centers to which the data have been provided, that the information provided is truthful, complete, accurate and up-to-date, and if it is not, to record your disagreement, to demand rectification and to be informed about the corrections made.

Declaration of origin of funds

With the acceptance, I expressly declare that: a) The income or assets of the company I represent, do not come from illicit activities contemplated in the Colombian Penal Code or in any norm that replaces, complements, or modifies it. Therefore, I declare that the income or assets of the company I represent are linked to the normal development of lawful activities of the corporate purpose, b) The resources derived from the development of the commercial relationship will not be used to finance terrorism, terrorist groups or illicit activities, c) No transactions or operations have been carried out for the realization or financing of illicit activities contemplated in the Colombian Criminal Code or in any regulation that replaces, adds, or modifies, or in favor of persons related to such illicit activities, d) In development of the corporate purpose of the company I represent, we have no links with third parties that are linked to money laundering or terrorist financing activities, e) Neither the shareholders, associates or partners, nor the legal representatives and members of the Board of Directors, nor the employees, are in the lists or national or international databases related to illicit activities and I authorize Zonepharma S.A.S., to carry out the verifications that it deems pertinent. In the event of any finding, Zonepharma S.A.S., may terminate any commercial relationship and notify the competent authorities of the events found, f) There is no firm court ruling against the shareholders, legal representatives and members of the Board of Directors, or employees, convicting them of the commission of crimes of financing terrorism or money laundering, g) I declare that the company I represent complies with the anti-bribery and anti-corruption legislation and regulations and that in the event of knowing any activity or operation suspected of money laundering, this will be reported and reported immediately to both the authorities and Zonepharma S.A.S.

Sales

If you wish to purchase any product or service available through the Service (“Solutions”), you must contact us via the contact form. We will never ask you for payment information such as your credit card number, credit card expiration date, and verification number.

Zonepharma S.A.S., reserves the right to terminate or suspend your access immediately and at any time, without prior notice or liability, for violation or breach of the terms and conditions previously accepted.

Limitation of Liability

In no event shall Zonepharma S.A.S., nor its directors, employees, partners, agents, suppliers or business affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, information or other intangible losses, resulting from (i) your access to or use to access or use the Service; (ii) any criminal conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

Medical promotional material

In the specialty’s pages, you can find information that is cataloged as Medical Promotion. Access to this information is restricted to medical or health personnel, in accordance with the Colombian law on medical promotion. To access this information, you must be a healthcare professional with faculty to prescription.

Resignation

It is recommended to use the Service responsibly and with this you agree that any risk or damage caused is your sole responsibility, the Service is provided “AS IS” and “AS AVAILABLE”.

Zonepharma S.A.S., does not warrant that a) the Service will operate uninterrupted, securely, or available at any particular time or place; (b) any errors or defects shall be corrected; c) the Service is, to the extent possible, free of viruses or other harmful components; or d) the results of the use of the Service will comply with the terms and conditions set forth herein.

Applicable law

These Terms shall be governed by and construed in accordance with the laws of Colombia and applicable international treaties thereon.

If any provision of these Terms is held unenforceable by a court of any jurisdiction, the remaining provisions of these Terms shall remain in effect. These Terms constitute the entire agreement between Zonepharma S.A.S. and You with respect to the Service.

We reserve the right, in our sole discretion, to modify or replace these Terms and Conditions at any time without notice.
